三张票据日期 2022 年 11 月 18 日：Volcano $25 million，West 4 $6 million，Comrit $11 million（2023 年 7 月 3 日转让给 Volcano）。票面利率 12%；违约 14%。IB 赎回所得的百分之九十归贷款方；2024 年 4 月修正将该比例拆为 77% Volcano / 13% West 4。Crew 是唯一具名担保人。Wettengel 代表 IB 签署；Muro 作为 CRO 代表 Versity Invest 签署。
Sapir 2025 年 4 月 7 日的确认书称，借款人在 2023 年 11 月之后未付利息。BCLP 违约通知日期 2024 年 11 月 11 日（致 Frank Muhlon）要求 $44,611,907，并指控付给 IB $4 million 收购费。贷款方催收，不是认定。
2025 年 7 月 15 日 Crane 缺席部分准许无异议的 CPLR 3213 动议。Crew 既未出庭也未抗辩。2025 年 9 月 30 日书记官金钱判决：Volcano $45,498,832.38；West 4 $4,494,349.18；费用 $535。

- 11 Nov 2024BCLP default demand on the Apex IB notes and Crew guaranties: $44,611,907. Lender letter says the IB distributed $4 million in acquisition fees to itself. Demand, not a finding. Addressed to Frank Muhlon.
- 8 Apr 2025IBI Volcano and West 4 Capital move for summary judgment in lieu of complaint against Crew on the Apex IB guaranties (NY Index 652237/2025). Motion seeks $47,196,315 as of 31 Mar 2025.
- 15 Jul 2025Crane (NY Index 652237/2025) grants the unopposed CPLR 3213 motion in part on default. Crew neither appeared nor opposed. Judgment directed: $42,953,402 to IBI Volcano (including assigned Comrit) and $4,242,913 to West 4, plus 14% from 1 Apr 2025. Attorneys’ fees denied without prejudice.
