IBI Volcano（Ziv Sapir）と West 4 Capital LP は、Apex South Creek 背後の残余持分ノートについて Crew を訴えた。KHCA の Vintage / Walk / One on 4th / Hayworth 枠とは別の積み重ねである。
三通の手形、日付 2022 年 11 月 18 日：Volcano $25 million、West 4 $6 million、Comrit $11 million（2023 年 7 月 3 日 Volcano へ譲渡）。クーポン 12%；不履行 14%。IB 償還代金の九割は貸手へ。2024 年 4 月の修正はその割を 77% Volcano / 13% West 4 に分ける。Crew が唯一の指名保証人である。Wettengel は IB のために署名。Muro は CRO として Versity Invest のために署名。
Sapir の 2025 年 4 月 7 日宣誓は、借り手が 2023 年 11 月以降利息を払っていないと言う。BCLP 債務不履行通知 2024 年 11 月 11 日（Frank Muhlon 宛て）は $44,611,907 を求め、IB へ 400 万ドルの取得手数料を主張した。貸手の催告であり、認定ではない。
2025 年 7 月 15 日 Crane は反対のない CPLR 3213 申立てを欠席により一部認容した。Crew は出頭も反対もしなかった。2025 年 9 月 30 日 書記官の金銭判決：Volcano $45,498,832.38；West 4 $4,494,349.18；費用 $535。
